Reasonable Accommodation Under The ADA

If the person with a disability is otherwise qualified to perform the essential functions of the job, then the employer has an affirmative duty to make a reasonable workplace accommodation that does not constitute an undue hardship for the employer. A reasonable workplace accommodation allows the employee with the disability to perform at the same level of effectiveness and efficiency as any other qualified employee.

The EEOC enforces this law. The timeframe for filing of a complaint is the same as Title VII and the ADEA -- 180 days, unless there is the opportunity to file under state or local law, in which case filing with the EEOC may be extended to 300 days after the alleged discrimination. The complaint must be filed with the EEOC before filing a lawsuit in federal court.
